ARREST WARRANT AGAINST LTTE AREA LEADER WHO WANTED TO DEFY SRI LANKA JUDICIARY RECALLED AND CASE AGAINST HIM DISMISSED

February 18,11:09 AM:Under a political understanding reached between the Ranil Wickremesinghe government and the Liberation Tigers of Tamil Eelam the Nilaveli area LTTE leader who wrote on a notice to appear in the Trincomalee magistrate courts that he did not intend to appear in courts deliberately to defy the judiciary was released by the Trincomalee magistrate S.Thiagendran in the case filed against him.

Since the police did not press for charges the warrant issued to arrest him for not appearing in the courts was also recalled

Thooyavan, the Nilaveli area LTTE leader wrote on the notice delivered to him to appear in the Trincomalee magistrates courts that he did not intend to appear in the courts and delivered that to the police. When he did not appear the magistrate issued an open warrant to arrest him. The magistrate has withdrawn the warrant now.

Thooyawan and his colleagues built a LTTE war memorial in the area under the control of the Sri lanka government to which the Sri Lanka Navy opposed. On a complaint by the Navy Kuchcheveli police filed a case under section 81 of the Criminal Procedure code against Thooyavan.

The police in this plaint said the war memorial was built in a land belonging to the Road Development Authority and the construction was a threat to the peace in the area and it was against the ceasefire agreement.

The case would have come up for trial on March 17 but it was taken up on February 17 , one day ahead of the no-confidence motion against the government in the parliament on a motion filed by the LTTE lawyer.

The police has been instructed not to proceed on the case further by the government.

The magistrate discharged the case.
