Enjoining Order on JHU appointed MP extended until June 29

June 26, 07.45 AM:The Colombo District Court extended its earlier enjoining order restraining Jathika Hela Urumaya member Buddhist monk, Akmeemna Dayaratne from functioning as a Member of Parliament until June 29 Tuesday, when the case was taken up June 25.

The order was sequel to an application by President’s Counsel Wijedasa Rajapakse to extend the Enjoining order.

The JHU nominated Akmeemana Dayaratne , a Buddhist monk member of the political party , claiming he was nominated in place of Venerable Kathaluwe Rathnaseeha , who was a rebel JHU Member of Parliament had resigned.

In his submissions to the District Court, the rebel MP, Venerable Kathaluwe Rathnaseeha disputed he resigned but was forced to resign from his parliamentary seat.

In this case Venerable Venerable Kathaluwe Rathanaseeha has cited Patalee Champaka Ranawaka , Omalpe Sobhita Thera, Kolonnawe Sumangala Thera, Uduwe Dhammaloka Thera and Akmeemana Dayarathna Thera as co respondents.

Counsel for the 5th respondent , the newly nominated MP submitted Romesh de Silva PC submitted the court had no jurisdiction to grant an enjoining order restraining a Member of Parliament from functioning as an MP . Parliament is the Supreme judge on its own members.

While no verdict was delivered on the issue District Judge S. M. S. Samarakoon Samarakoon said a full investigation of all issues would be taken when the case is taken up on the 29th.
